These Terms Of Use, Together With The Privacy Policy, Cancelation Policy Are Available At Www.dishwasherhelp.com (“privacy Policy”) And The Rules, Policies, Terms And Conditions Set Forth In, Referred To And/or Linked Herein, All Of Which Are Incorporated Herein By Reference, Are, Collectively, The “agreement”. This Agreement Constitutes A Legal Agreement Between You (“you” Or “user”) And Dishwasherhelp Inc. D/b/a Dishwasherhelp (“dishwasherhelp.com” Or “us”).

This Agreement Governs Your Use Of Our Services And Platform That Facilitates Communications Between Users Offered Through Our Website Located At Dishwasherhelp.com As It May Be Modified, Relocated And/or Redirected From Time To Time.

By Accessing Or Using This Website Or Any Other Websites Of Dishwasherhelp Inc. Or Its Affiliates Or Agents (Dishwasherhelp) With Links To This Agreement (Collectively, The “website”) In Any Way, Including Using The Services And Resources Available Or Enabled Via The Website And Application (Each A “service” And Collectively, The “services”) By Dishwasherhelp Or Users Of The Site (“users”), Clicking On The “i Accept” Button, Completing The Registration Process, And/or Merely Browsing The Website, Or Downloading Dishwasherhelp’s Mobile Application (The “application”),

You Represent That
(1) You Have Read, Understand, And Agree To Be Bound By The Terms Of Use, (2) You Are Of Legal Age To Form A Binding Contract With Dishwasherhelp. (3) You Have The Authority To Enter Into The Terms Of Use Personally Or On Behalf Of The Dishwasherhelp You Have Named As The User, And To Bind That Dishwasherhelp To The Terms Of Use. The Term “you” Refers To The Individual Or Legal Entity.

As Applicable, Identified As The User When You Registered On The Website. If You Do Not Agree To Be Bound By The Terms Of Use, You May Not Access Or Use This Website, The Application, Or The Services. Please Note That The Terms Are Subject To Change By Dishwasherhelp In Its Sole Discretion At Any Time.

Dishwasherhelp provides an online marketplace that connects Users who are willing to provide Professional Services (“Professional(s)”) with Users who are looking for Professionals (“Requesters”). Each Requester request for Professional Services (a “Booking Request”) to be provided by one or more Professionals (the “Professional Services”) is hereinafter referred to as a “Mission”.

In providing the Service under this Term of Use it is expressly agreed that Talent is acting as an independent contractor and not as an employee. Therefore, the Requester is solely responsible for any damages due to its negligence and liable for any injuries occurred at his workplace and to pay any indemnity to Talent.

While Dishwasherhelp supplies Requesters with Professionals who are available to provide Professional Services for Missions and facilitates these Missions by supplying a medium for exchange of money between Requesters and Professionals.

Dishwasherhelp does not take part in the interaction between Users. We do not have control over the quality, timing, legality, or failure to provide Professional Services or any aspect whatsoever of any ratings provided by Users, or of the integrity, responsibility, or any actions of any Users.

NEITHER DISHWASHERHELP NOR ITS AFFILIATES OR THIRD-PARTY PROVIDERS IS RESPONSIBLE FOR THE CONDUCT, WHETHER ONLINE OR OFFLINE, OF ANY USER OF THE SERVICES. DISHWASHERHELP AND ITS THIRD-PARTY PROVIDERS WILL NOT BE LIABLE FOR ANY CLAIM, INJURY OR DAMAGE ARISING IN CONNECTION WITH YOUR USE OF DISHWASHERHELP PLATFORM.

Certain Restrictions. The rights granted to you in the Terms are subject to the following restrictions:

1. you shall not license, sell, rent, lease, transfer, assign, reproduce, distribute, host or otherwise commercially exploit Dishwasherhelp Platform or any portion of Dishwasherhelp Platform, including the Website.
2. you shall not frame or utilize framing techniques to enclose any trademark, logo, or other Dishwasherhelp Platform (including images, text, page layout or form).
3. you shall not use any metatags or other “hidden text” using Dishwasherhelp’s name or trademarks
4. you shall not modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of Dishwasherhelp Platform except to the extent the foregoing restrictions are expressly prohibited by applicable law
5. you shall not remove or destroy any copyright notices or other proprietary markings contained on or in Dishwasherhelp Platform. Any future release, update or other addition to Dishwasherhelp Platform shall be subject to the Terms. Dishwasherhelp, affiliates and third-party providers reserve all rights not granted in the Terms. Any unauthorized use of Dishwasherhelp Platform terminates the licenses granted by Dishwasherhelp pursuant to its Terms.

Text messaging. By creating an Account, you agree that the Services may send you informational text (SMS) messages as part of the normal business operation of your use of the Services.

Third Party Payment Services Provider. Dishwasherhelp uses Stripe as a third-party service provider for payment services (e.g., credit card transaction processing, merchant settlement, and related services). By using Dishwasherhelp Platform, you agree to be bound by Moneris’s and Stripe’s Terms of Service: and https://stripe.com/us/terms and their Privacy Policy. You hereby consent to provide and authorize Dishwasherhelp and Stripe to share any information and payment instructions you provide to the extent required to complete the payment transactions in accordance with the Terms, including personal, financial, credit card payment, and transaction information.

Payment.Each User understands and agrees that: The transmission of funds in the manner described herein is not a separate and discrete service that Dishwasherhelp provides in addition to the Services. Dishwasherhelp acts as agent of each User and not as a trustee or fiduciary with respect to payments received through Dishwasherhelp.

Term of Cancellation of Professional Services; Survival.

1. Term.This Agreement shall continue in full force and effect until such time as it is terminated by you or by us.
2. Termination by Dishwasherhelp.To the extent permitted by applicable law, we may terminate this Agreement or terminate or suspend your right to use the Dishwasherhelp Platform at any time for any or no reason (including, without limitation, in the event that we believe that you have breached this Agreement or any policy posted on the Dishwasherhelp Platform, or if we otherwise find that you have engaged in inappropriate and/or offensive behavior (collectively, “Prohibited Conduct”)) by providing you with written or email notice of such termination to the physical or email address you have provided us, and termination will be effective immediately upon such notice.
3. Termination by You. You may terminate this Agreement by completely and permanently ceasing to use the Dishwasherhelp Platform (if there are no outstanding Professional Services ordered under your password or account) and by closing any account you have opened on the Dishwasherhelp Platform. If you attempt to terminate this Agreement while there are still outstanding Professional Services ordered under your password or account, this Agreement shall not terminate until such Professional Services have been performed or otherwise canceled as permitted by Dishwasherhelp.

Changes to this Agreement. We reserve the right, at our sole and absolute discretion, to change, modify, add to, supplement or delete any of the terms and conditions of this Agreement at any time, effective with or without prior notice.

Consumer Complaints. In accordance with our consumer complaints policy, you may report complaints to them at +1 514-918-3111.

Entire Agreement. The Terms are the final, complete and exclusive agreement of the parties with respect to the subject matter hereof and supersedes and merges all prior discussions between the parties with respect to such subject matter.
